IMPORTANT: Please read these Terms of Use carefully before using Stillwater. By downloading, installing, or using the app, you agree to be bound by these terms. If you do not agree, do not use the app.
Stillwater is an iOS wellness application that provides short, evidence-based exercises to help you manage everyday anxiety. The app is operated by Stillwater App, a sole proprietorship based in California.
Stillwater is a wellness tool, not a medical product. Nothing in this app — including exercises, techniques, journal prompts, AI-assisted suggestions, or any other content — constitutes medical advice, diagnosis, or treatment. Stillwater is not a substitute for professional mental health care, therapy, or medical treatment of any kind.
The techniques offered in Stillwater are general wellness tools that many people find helpful. They are not personalized clinical interventions and have not been evaluated by the FDA as medical treatments.
If you are experiencing a mental health crisis, thoughts of self-harm, or a medical emergency, stop using this app and contact emergency services or a crisis line immediately:
Stillwater is not designed, intended, or equipped to handle mental health emergencies. Do not rely on this app in a crisis.
You must be at least 13 years old to use Stillwater. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the app. By using Stillwater, you represent that you meet these eligibility requirements.
When you first open Stillwater, an anonymous account is automatically created so your toolkit and preferences can be saved. You may optionally add an email address to enable cross-device access and account recovery. You are responsible for keeping your login information secure.
You can delete your account and all associated data at any time from within the app. Deletion is permanent.
Stillwater includes an optional AI-assisted feature that reads text you type into the app and suggests relevant wellness techniques. This feature is powered by Anthropic's Claude API.
You understand and agree that:
You agree not to:
You own everything you write in Stillwater — your journal entries, custom toolkit items, and any other content you create. You grant us a limited, non-exclusive license to store and display that content to you within the app. We do not claim ownership of your content and do not use it for any commercial purpose.
You are responsible for the content you enter. Do not enter sensitive personal information of others (e.g., other people's medical information) into the app.
The Stillwater app, including its name, logo, design, content, and underlying code, is owned by Stillwater App and is protected by copyright and other intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the app without our prior written permission. The name Stillwater and the app's visual identity are proprietary to Stillwater App.
Stillwater relies on third-party services (Supabase, Cloudflare, Anthropic) to operate. These services have their own terms of use and privacy policies that govern their handling of data. We are not responsible for the practices of these third-party services beyond our contractual relationship with them.
Links or references to third-party content within the app are provided for informational purposes only. We do not endorse and are not responsible for third-party content.
Stillwater is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the wellness techniques provided will produce any particular result for any particular person.
To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Stillwater App and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of revenue, or harm arising from reliance on the app — even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to these Terms or your use of the app shall not exceed the greater of (a) the total amount you have paid us in the twelve months preceding the claim, or (b) fifty US dollars ($50.00).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Stillwater App and its owner from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the app; (b) your violation of these Terms; or (c) your violation of any third-party rights.
Stillwater is not a crisis service and is not monitored by licensed clinicians. The app is not designed for users who are in immediate danger, experiencing suicidal ideation, or in need of emergency psychiatric care.
If you are in crisis: call 911 or text/call 988 (Suicide & Crisis Lifeline). Do not attempt to use this app as a substitute for emergency care.
By using Stillwater, you acknowledge that it is a general wellness tool, not a clinical resource, and that you take sole responsibility for decisions about your mental health care.
We may update these Terms from time to time. If we make material changes, we will notify you within the app. Your continued use of Stillwater after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree to revised Terms, you should stop using the app and delete your account.
We may also change, suspend, or discontinue any aspect of the app at any time without notice, though we will do our best to let you know in advance of significant changes.
We reserve the right to terminate or suspend your access to Stillwater at any time, with or without cause, if we believe you have violated these Terms or if continued access poses a risk to other users or to the app.
You may stop using the app at any time by deleting it from your device. If you have an account, we encourage you to delete it first through the in-app account deletion flow.
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or your use of the app shall first be addressed by contacting us directly at privacy@seekstillwater.app. We will make a good-faith effort to resolve any dispute informally.
If informal resolution fails, disputes shall be resolved by binding arbitration in California under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Stillwater is distributed through Apple's App Store. You acknowledge that:
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Stillwater App regarding your use of the app and supersede all prior agreements and understandings.
